These Terms of Service ("Terms") govern your access to and use of the Song Circles website and services (the "Service"), operated by Song Circles from California, United States. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 13 years old to use the Service. You are responsible for your account, for keeping your sign-in credentials secure, and for all activity that occurs under your account. Provide accurate information and keep it up to date.

2. Your content

You retain ownership of the content you post — your music links, posts, replies, photos, and profile information ("Your Content"). By posting, you grant Song Circles a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute Your Content solely as needed to operate and improve the Service. You represent that you have the rights to everything you post and that it does not infringe anyone else's rights.

3. Acceptable use

You agree not to:

• Use the Service to coordinate artificial streaming, fake engagement, or any activity that violates the terms of music platforms.
• Harass, threaten, or abuse other members.
• Post content that is unlawful, infringing, deceptive, or harmful.
• Attempt to access other members' accounts or circles you are not a member of.
• Use automated means to scrape, spam, or overload the Service.
• Impersonate any person or misrepresent your affiliation with anyone.

4. Circles and community

Circles are small communities run by their admins. Admins may accept or decline join requests and remove members from their circle. Song Circles may feature curated showcase content to spotlight independent music; showcase circles and profiles are managed by Song Circles, not by the featured artists.

5. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service. Upon termination, sections that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any content will remain available.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SONG CIRCLES AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

8. Indemnification

You agree to indemnify and hold harmless Song Circles and its operators from any claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms.

9. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
